These terms govern your use of the MA Media website and the advertising, media-planning and campaign services supplied by us.

By accessing this website, submitting an enquiry, accepting a quotation or using any service provided by MA Media, you agree to these Terms and Conditions. If you do not agree, please do not use the website or services.
1. About MA Media

2. Website Use
You agree to use this website only for lawful purposes. You must not:
- Attempt to gain unauthorised access to the website, server or connected systems.
- Upload malicious code, interfere with website operation or misuse contact forms.
- Copy, scrape, reproduce or commercially exploit website content without permission.
- Use false information, impersonate another person or submit unlawful campaign material.
3. Enquiries, Proposals and Quotations
Website enquiries do not create a binding service agreement. A campaign becomes confirmed only after the scope, location, duration, media inventory, price, taxes, artwork requirements, payment terms and other conditions are accepted in writing and any required advance is received.
Quotations are valid for the period stated in the quotation and remain subject to media availability, publisher or media-owner approval and applicable taxes.
4. Media Availability and Third-Party Approval
Advertising inventory may be owned or controlled by third parties. Availability can change without notice and bookings may require approval from publishers, radio stations, cinema networks, outdoor media owners, local authorities or other partners.
If selected inventory becomes unavailable, we may propose a comparable alternative, revised dates or a refund/credit for the affected unperformed portion, subject to the relevant media owner's terms.
5. Client Responsibilities
The client is responsible for:
- Providing accurate campaign details, billing information, artwork, approvals and deadlines.
- Ensuring that advertising content is lawful, accurate, non-misleading and does not infringe third-party rights.
- Obtaining permissions for trademarks, images, testimonials, claims, music and other materials supplied to us.
- Reviewing proofs and approving artwork, schedules and media plans before release.
- Paying invoices and applicable taxes according to agreed terms.
6. Content Standards and Right to Reject
We may reject, suspend or request changes to material that is unlawful, defamatory, obscene, discriminatory, misleading, infringing, politically restricted, technically unsuitable or inconsistent with a media owner's policy. Final acceptance may rest with the relevant media owner or authority.
7. Pricing, Taxes and Payment
Prices are stated in the quotation or invoice and may exclude GST, production, printing, installation, permit, creative, monitoring or other charges unless expressly included. Payment schedules may vary by campaign and media channel.
We may pause work, withhold booking confirmation or suspend a campaign where payment is overdue. Any bank charges, payment gateway charges or statutory levies are payable as stated in the quotation.
8. Changes, Cancellation and Refunds
Change and cancellation requests must be made in writing. Charges depend on campaign stage, production already completed and the cancellation policy of the relevant publisher or media owner.
- Non-refundable media bookings or production costs remain payable.
- Artwork revisions beyond the agreed scope may be charged separately.
- Approved campaigns cannot always be stopped after release or installation.
- Eligible refunds, if any, are processed after third-party reconciliation.
9. Campaign Performance
We use reasonable skill and care in planning and executing campaigns. However, advertising results depend on many factors outside our control, including audience behaviour, market conditions, competition, location, creative quality, offer and campaign duration. We do not guarantee a specific number of leads, sales, impressions or business results unless expressly agreed in writing.
10. Delays and Force Majeure
We are not responsible for delays or failure caused by events beyond reasonable control, including weather, government restrictions, strikes, technical outages, printing problems, authority action, transport disruption, media-owner failure, public emergencies or natural disasters.
11. Intellectual Property
Website content, branding, layouts and materials created by MA Media remain our intellectual property unless assigned in writing. Client-owned trademarks and supplied materials remain the client's property. Final creative ownership and usage rights are governed by the applicable proposal or agreement.
Unless confidentiality or written restrictions apply, we may reference completed campaigns in our portfolio and marketing materials after public release.
12. Confidentiality
Each party will take reasonable steps to protect confidential commercial, pricing, campaign and business information received from the other party. This obligation does not apply to information already public, independently developed or required to be disclosed by law.
13. Third-Party Services and Links
Our services may involve third-party publishers, media owners, analytics tools, payment services and communication platforms. Their separate terms may apply. We are not responsible for the independent operation or content of third-party websites linked from our site.
14. Limitation of Liability
To the fullest extent permitted by law, MA Media will not be liable for indirect, incidental, special or consequential losses, including loss of profit, reputation, opportunity, data or anticipated savings. Our aggregate liability for a claim will not exceed the amount paid to us for the specific service giving rise to that claim, except where liability cannot legally be limited.
15. Indemnity
You agree to indemnify MA Media against claims, penalties, losses and reasonable costs arising from content or instructions supplied by you, infringement of third-party rights, unlawful advertising claims or breach of these terms.
16. Privacy
Personal information is handled according to our Privacy Policy, which forms part of these terms.
17. Termination
Either party may terminate services according to the applicable proposal or agreement. We may suspend or terminate work immediately for non-payment, unlawful instructions, material breach or conduct that creates legal, reputational or operational risk.
18. Governing Law and Jurisdiction
These terms are governed by the laws of India. Subject to any mandatory dispute-resolution requirements, courts with jurisdiction in Agra, Uttar Pradesh will have jurisdiction over disputes.
19. Changes to These Terms
We may update these Terms and Conditions when our services, business practices or legal requirements change. Updated terms will be posted on this page with a revised date.
